1. Acceptance of Terms

By creating an account or using Maily ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Maily is an email marketing platform that allows you to create, manage, and send email campaigns to your subscribers. We provide AI-assisted content generation, campaign analytics, automation workflows, and subscriber list management.

3. Account Responsibilities

  • You must provide accurate information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access.
  • You must be at least 18 years old to use the Service.
  • One account per person or business. Creating multiple accounts to bypass limits is prohibited.

4. Acceptable Use

You agree NOT to use the Service to:

  • Send spam or unsolicited emails to people who have not consented to receive them
  • Send emails that violate CAN-SPAM, GDPR, CASL, or any other applicable email law
  • Distribute malware, phishing links, or deceptive content
  • Harass, threaten, or harm any individual
  • Violate any applicable law or regulation
  • Reverse-engineer, copy, or replicate the Service
  • Resell or sublicense access to the Service without written permission

Violation of these rules will result in immediate account suspension without refund.

5. Email Compliance

You are solely responsible for ensuring your email campaigns comply with all applicable laws. This includes having a valid unsubscribe mechanism (provided by us), a physical mailing address, and only emailing subscribers who have given explicit consent. You must honor unsubscribe requests within 10 business days.

6. Subscription & Billing

  • Paid plans are billed monthly or annually in advance.
  • All payments are processed securely by Stripe.
  • You may cancel your subscription at any time. Access continues until the end of the billing period.
  • We do not offer refunds for partial months unless required by law.
  • We reserve the right to change pricing with 30 days' notice.

7. Free Plan Limitations

Free plan accounts are subject to sending limits, subscriber limits, and feature restrictions as described on our pricing page. We may add a "Powered by Maily" footer to emails sent on free plans.

8. Intellectual Property

The Service, including its design, code, and content, is owned by us and protected by copyright. You retain ownership of all content you create and upload. By using the Service, you grant us a limited license to store and transmit your content solely for operating the Service.

9. Termination

We may suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time from your profile settings. Upon termination, your data will be deleted within 30 days.

10. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost profits or data. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or by a notice on the Service. Continued use after notice constitutes acceptance of the new Terms.
